View Full Version : Help....Uninsured motorist Hit my Car..

I hope Stu can help me with this question.
I'm asking this for a friend of mine who in December got Rear-Ended by a 19 year old kid with no insurance. After he gave my friend his information, driver license, phone number, etc.. he told him not to call the COP and that he will pay for all the Damage. My buddy have been trying to get a hold of him but he never answer his Phone and when my friend come over his house his mom said he's not there. He have call his insurance and the Insurance (FARMER) has not been able to contact the Punk either. My Buddy Drive a 2000 Honda Accord EX 4cyl. Rear-bumper is fuck, the metal rear bumper support is bent, one of the rear light is crack. Can't close the Trunk. But both Rear Quarter Panel seem Fine.
What do you think my friend should do?
File a Small Claim Court?
Let the Insurance take care of it?
Take care of it the OLD FASHION way?

Without proof that it was the kid that hit him (no police report) he has no leg to stand on. Its time to start putting pressure on him since he knows where he lives.

Did your friend file a police report at all? Even if the cops weren't called, you can still file a report.
If your friend has collision coverage on his policy, have him go thru his insurance company. He's gonna have to fork out the deductible, but the insurance company will do their best to try and get that money from him (because they want their money too). However, in most of these deadbeat situations...you never recover your deductible.
For future reference: ALWAYS, ALWAYS, ALWAYS call the police and NEVER listen to their sad pitiful stories about how they're gonna pay for the damages or lose their license. THEY NEVER PAY (coming from 10 years in the insurance industry, btw).

Yeah, if someone asks you to not call the cops, that's a pretty good reason to go ahead and call them. It's always a good idea to call them and have them document things anyway.
Everyone else pretty much covered it. If his insurance company is Farmers, then he's not uninsured. If your friend would have filed a police report, Farmers would have had a statement from your friend, and a police report to go off of. As it stands now, they only have one account of the accident. Farmers should send one of their field reps out to go to the kid's home.

They more than likely won't because the damage may not be enough, but I'm not real familiar w/ Farmers.
They still have a duty to investigate the claim though. I'd insist that they send the field out to see if the car is at home to inspect it for damage. But that's only because I know they can do that.

when i got rear-ending recently. the other driver said not to call the police as well. so at first i thought "oh noez....he might not have insurance." but he was with his 2 kids. so we exchanged info then 2 days later get a call from his insurance company.
If I were you, id get a lawyer.

Same story here, only i got fucked on the deal. Dumbass hit my parked car, gave me his insurance info etc, he wasn't paying on it so I ended up having to go through my insurance. I don't trust anyone, I call the cops every time there is an incident now no matter what.

You can file a police report after the fact but I'm not sure how long after. That's what you have to do when there' s an accident alert

I remember something along the lines of 48 hours. I read it somewhere when I rear ended the Cadillac in December. Could have just been an insurance requirement, but I don't think so.

A buddy of mine got ripped off on some parts a long while ago, and when he tried to apply pressure to the little bastard, they filed harassment charges. Just a thought.....Maybe hire Conrad and Dave?

It might be too late to file anything with the popo but you should be able to work with your insurance and have them put pressure on the kid.
I would get a laywer, take it to small claims, and in the mean time, put your own kind of personal pressure on him. You have ALLLL the power in this situation. You have his name, phone number, adress...go to his house like everyday and let this little punk ass shit know your fkn serious. He's gotta be there eventually.
Yeah, great idea. Go to his house so he can take you to court for harassment.
