Well my brother left for the marines and he left me his car to take care of. Everything is in his name. would i be able to get insurance on the car under my name? or would the title and everything have to be in my name in order for me to insure it?

You have to get insurance before you get the title in your name. So no, you dont need it(title) in your name.

For a claim to be paid out, you have to have an insurable interest in the vehicle. Meaning, your name has to be on the title somewhere. Otherwise, you have to keep the insurance in your brother's name. It might not be a bad idea to add you on to his policy as an operator.

there is no insurance on the vehicle right now cause he doesnt drive it. i just talked to a buddy and he said that i can have my brother send me a letter stating that he hands over the title to his car over to me and just keep that in case i get pulled over or in a accident since he doesnt have the title to sign.

Can anyone varify this

Ide go with Dave L on the whole Adding your brother as well. Im not to sure about the whole "Claims" stuff. Although I never have to tell my insurance anything when adding or changing a vehicle. I just do it online. As far as what to tell them initially, I dont think the truth would be a bad idea

In theory, you could write up a bill of sale and keep it on hand, "just in case". Then if there's a claim you can say you just never got the title switched. Don't quote me on that. You might want to ask Stu on this. He deals with claims.

good info on this... i recently bought a truck from my father in law, i have insurance on the truck but i have not transfered ownership to my name yet. i need to get that shit done soon.

what did you say to the insurance when you went to get it insured since the title was not in your name(from what i understand) when you got insurance for it ??

If your brother gave you his car, then you need to put it in your name. If you are just taking care of it while he's gone, but have permission to drive it, then he needs to get an insurance policy, and add you on as a driver. Either way, it sounds like you'll have to hold off on driving it until you get this straightened out. If you can find the title, you can always mail it to your brother to sign as the seller; also have him sign the Bill of Sale that you are going to write up. Write up the Bill of Sale with the car info (Make, Model, year, miles, and VIN) put a line for the seller (your brother), buyer (you), and the amount (You can put like $500 and it will save you a lot on taxes at the DMV), and the date. Once you have a signed title and Bill of Sale, go get an insurance policy on the car in your name. Then take the title, Bill of Sale, and proof of insurance to the DMV and register the car in your name.

It sounds like a hassle, but I promise that this is the easiest way to go about this. It's also the most legitimate. Let us know if you have any more questions.

its a 92 civic hb (ls motor) the gauge cluster is fucked up and the numbers are all moved around and it doesnt have a accurate amount of miles on the odometer! what should i do about that?

Just write down the number that it says, and then check the box on the title that says something like "not actual mileage." There are I think three different boxes you can check in the odometer section of the title.

but the odometer just says like 10k and there is no way they are going to believe that. on the title doesnt it say how many miles were on the car when my brother purchased it? should i just go from those miles and just guess what it should be at?

You can guess. It doesn't really matter what you put, because you are checking the box that says that the mileage reading is not accurate. They don't have to believe it.

ok i pm'ed him seeing if he's the one so hopefully he pm's me back.

and what exactly do you do about claims. does it matter what insurance i have to go threw you if i get into a accident. cause my girlfriend just totalled our car and they are talking to the insurance place now but is there anything that you would be able to do to help with anything? lmk in a pm or on here it doesnt matter!

Stu pretty much summed it all up in his posts. You can't have insurance on something you don't own bc you won't suffer any financial loss in the event of a claim. A signed/dated bill of sale is just as good as a title in your name. Once the bill of sale is signed, the ownership transfers to the buyer and he/she is responsible for the insurance at that point.

well i think that we are going through our insurance comany that we have.

My girlfriend was driving our car 00 si. and she was turning left and she said she had a green light and some lady going the opposite way decided to go throught the intersection and wasnt paying attention and hit her and totalled the Si. there was some witness that said my girlfriend didnt have the green arrow. so we are trying to find a fed ex driver that might of seen it cause she was driving right next to her at turn and he never stop.

Unless you can prove that she had the green arrow, it is VERY unlikely that the other insurance company will accept liability. 99.9% of the time someone is in an accident when making a left turn, they are the at fault party. The only time for sure that they are 100% clear of liability is if the left turning car had a green arrow. A turning vehicle always has to yield to a straight vehicle, unless the turning person has the green arrow (and it can be proven). Even if the car going straight is running a red light, and the turning car was waiting in the intersection to turn left after all the traffic has stopped, it's still the turning cars fault. No injuries?

nothin major. my girlfriends sister went to the hospital to get looked at cause her neck hurt and she didnt know what was going on. my girlfriend didnt go to the hospital but she has bruises and is in some pain. we are trying to still find a fed ex employee that was turning at the same time. (her and the fed ex truck went trough the intersection) so that kinda tells me there was a chance that she had a arrow.

This is no longer true, DMV goes off the taxable value and not the purchase price. One of my recent vehicle purchases the actual purchase price was $1,269.00 but the taxable value was $14,258.00 and the plates and registration fee was over $1100.00.. So a small bill of sale will not save you on registration fees, since the calculation is off of the actual taxable value..

If im not mistaken This doesnt apply to older cars or cars with over XXX miles (cant remember which). That doesnt apply here obviously.

Not true. I bought my Accord for $100 and ended up paying less than $50 with registration and plates.

I told them my Rex cost me 300 and they charged about 40 or 30 in taxes. Which is cheap compared to California.
