It's not within your home, so you can only use an amount of force that's appropriate for protecting yourself from whatever threat they pose to you. However, I'd go out there with the means to defend myself, which should be enough to make any criminal take off running, fearing for his life... maybe then he will reconsider his life of crime.

And if it's inside your home, the Make My Day law allows you to use any amount of force you want when the criminal tries to use even the slightest amount of force against you.

There was a guy in Texas on the SRT-4 forums (I think there was a link here in the firearms section) that popped some scumbag breaking into his car and no charges were filed.

Also I remember years ago in Littleton (I think) some guy blasted a perp in the back while he was running away after fucking with with his car. He was tried but aquitted .

It's my understanding that Texas allows you to basically "shoot first, ask questions later" if a crime is being committed at night, but not neccessarily during daylight (I bet they're somewhat loose about that though). Colorado is more strict, so although some people have avoided convictions for such things, you are not explicitly guaranteed any protection from prosecution.
