Selling tickets to an Event...Quick question

Is it illegal to sell tickets to concerts and/or sporting events above face value?

I have some extra tickets to the Nuggets/Memphis(Melo's 1st game back w/ Iverson) game and friends keep telling me to Ebay them and see how much I can get for them.

I have 2 spare tickets. I don't have them on me right now so I don't know the exact location of the seats. They are 1-2 steps better then the cheap nose bleed seats. I paid $40/each after taxes and fees from ticketmaster.

I have no idea how much I'm selling them for, hence the reason I posted here:) I may try a 3 day auction on Ebay and see what happens unless one of you guys wants to make me an offer I can't refuse. I'll get the section information later on tonight, but they are good tickets.

The game is Monday January 22nd @ 7pm.

PM me offers if anyone is interested. I can meet you at the Pepsi center the night of the game. I may stick them on CL 1st if nobody here wants 'em, you guys are getting 1st dibs.

My options:
A) Sell to one of my buddies for face value
B) Sell to one of my HAI bretheren for something over face value
C) Sell to a random person at the game for WELL over face value

This will be a highly sought after game to go to, therefore I'm planning on making a few $$.

Technically you can't sell them above face value, or else is is considered scalping and is illegal. FYI.

If you offer the tickets for whatever marked up value and a pair of 2.99 sunglasses it's ok. This worked since the tickets have face value right on them, but you can't prove the value of the sunglasses. When I went to a nugs game with Steve C he sold his extra tickets to a scalper, when we asked the guys who bought them they said it was 10 bucks over value but included a parking pass.

Thats what I assumed, but nobody has been able to verify it for sure. More then one person I asked mentioned the "500 yard rule" or something like that. I dunno, some friends and HAI members have offered above face value already so I'll see what happens.

That reminds me of a CU vs. CSU game I went to a few years ago(when the games were fun and exciting). My buddy and I sold out tickets to a scalper for $5-10 below face value and it turns out the kids that bought them paid $25-30 over face value! I just remembered that.
