View Full Version : Am I getting screwed by my auto insurance?!

Sorry for the long read!

I am trying to help my poor mom out. She is an a old Chinese woman that cant read or write english and cannot speak it very well either. She seems to get taken avantage of alot ao I am trying to help her out.

She has an auto insurance policy with a Allstate. My sister was under her policy with a Del Sol that my mother owns. In July of this year my sister moved out and my mother took back the car. She dropped the car off the policy and asked to have my sister removed as well. My sister currently does not drive nor does she own a car.

My mother asked me to read her last bill, Well it turns out my mother is still getting charged to have my sister on the policy she has been getting charged this whole time. I called her agent and he states that by Colorado Law he cannot remove her unless he gets her current policy number and company and when they get that they will refund my mom the money?! I was like WTF, why do you need this information non of the vehicles on my moms policy has a loan or any need for that type of info. and she is now an adult! So I told him that my sister does not drive now so how can she have a policy!

Well after that he tells me that he will remove her but by "Colorado Law" he cannot refund my mom the money because my sister doesnt have another policy somewhere else! WTF is this true this guys like the throw the "Colorado Law" phase around alot. I dont claim to know the law but it seems ridiculous that this is required by Colorado.

So is this guy full of shit and is just trying to suck more money out of my mother or does he really have a leg to stand on. It just sounds ridiculous to me but I could be wrong. Any help from you insurance guys is greatly appreciated I would like to help my mom out here, thanks in advance!

I work for Allstate so I can try to help you out in any way. Its people like this that give insurance agents bad names. To remove a young operator we have to get certain info for liability reasons. We have to give a reason why we are removing the young operator and have several choices. One of those choices is the one your mom's agent is giving her. "New policy with new company". In that situation, we do have to get a copy of the new policy. However, there is another option. "Young driver is no longer in household". In this case, we have to have a seperate address and phone number for the young operator. What I would recommend you do, is get a copy of your sister's lease showing when she moved out. Tell the agent that you can provide this info that she was no longer in the household as of that date and he should remove her as of then. Let me know if he gives you any more problems.

Thanks alot yes my sister is no longer in the household. I just gave him her address and phone number over the phone and he said he would remove her. But she is 20 now is she still considered a young operator? I guess until she is 25 huh?

Even though he is removing her can my mother get back the money she has paid for her since July? I mean my mother asked back then and the agent admits that she did but they never told her that she had to provide this information till I called. The car that my sister drove was removed that same day but she wasnt and no information was given to my mother about it she was just told it would be done. So what are her odds of her getting her money back if I provide the lease showing the move in date in July?

Thank you so much for the help Dave!!!!! It would be so much more simple if the agent just explained it to me like that instead of saying "Colorado Law" over and over again.

You should be able to be refunded that money when they back date the elimination of your sister off the policy.

There are certain things that insurance companies can't pay you for because they violate contract law, but this should not be one of them.

Under 25 is considered a young operator so you'd still have to provide that info. I think the odds are good that she can get her money back. Its just a matter of being firm with the agent. Afterall, it was his job to let your mom know what was needed to remove your sister off the policy. If he would have told her and then your mom never got the info, that's a different story. I'd say get a copy of the lease and even go by his office with it. Its a lot easier to discuss it in person than over the phone. Show the date the lease started with her name on it and that will be enough proof that she was out of the household as of that date. Then he can backdate the endorsement and refund any premium back to your mom.

I'm happy to help out. There are a lot of jack ass agents out there that will do anything to make an extra few bucks. Our office remembers who we work for and we always do the right thing, even if it costs us. In the end, its well worth it. Let me know if you have any other questions or if he still refuses to do it. If he still refuses, I know of another route we can take but I'd rather give the agent a chance to do the right thing.

That is really good advise, thank you so much my mother will be very happy that something went her way. I am just not around enough to help her with everything and I feel bad. She has worked very hard to become an American citizen and everything she has. She is 62 and will never be able to retire she still works 12+ hours a day as a cook and janitor. It sucks that people take advantage of her like this. Your help is greatly appreciated hopefully things will go her way for once and I wont have to push to hard to get it. Thanks again!
