Ok, so I bought something off eBay and when I got the item it turned out to be WAYYYYY different than the description.

(It was a hockey jersey that was listed as lightly used, like new, no tears or holes with a few marks that should remove after being washed).

Anyways... we got the jersey and it has sooo many stains that it's not even funny. I am serious, it has like 20 stains on it (many of which look like drops of red kool-aid) and also had a hole on the back. I e-mailed the guy about it today and told him that I was unhappy and that I would like to return the item and he says "ok, I'm sorry about that... if you'd like to keep it I can refund the difference" I told him "no, I want to return it" So he told me to go ahead and send it back.

What does everything think is the RIGHT thing to do in a situation like this?

1. Who pays return shipping?
I think he should have to since the item was not what he said it was. The only time someone should have to pay return shipping is if they changed their mind, bid on the wrong thing, etc;

2. Do I return the jersey and wait for credit OR does he need to credit me and then I send the jersey?
(Should I tell him that I want my money back before sending him the jersey? This is where I'm really unsure, because I want him to refund the jersey, original shipping and return shipping)

I have bought a ton of stuff off eBay and haven't had a lot of trouble, but then you run into people like this.

Thoughts, anyone?

how did you pay credit card or paypal? if it was paypal file a dispute i think there is an option on there that says "item not as described" i believe you are responsible for return shipping but maybe can be asked to be repaid?

I don't see why I have to pay the return shipping (he already overcharged me anyways) I paid $8.00 and it only cost him $4.05. I figure he owes it to me... I shouldn't be punished for his mess up. I actually just got an e-mail back from him and he said he would pay me the return shipping back so we'll see what happens.

Sounds like he knew what he was doing and is being cooperative. That's the best you can hope for in that type of situation.
