If I sell my car to a person and it has not been 2 years since the last emission when it passed.... so do I have to get it re-tested or is it their responsobility"SP"?? so please let me know as soon as u can!:worshippy :worshippy :worshippy

Usually, the buyer gets it tested, but I've heard something about the seller being responsible if it fails... I'm not sure if that was just for dealerships, or if it applies to all sales.

the seller is responsible for making sure that it is able to pass prior to the sale. if the buyer takes it to get tested and it doesnt pass, they can pursue the seller to pay for whatever it takes to get it to pass.

I thought it was the sellers responsibility to get it tested unless it has passed in the past 12 months.

An emissions test is required when a vehicle is sold or the ownership changes. The seller is responsible for obtaining the test. This requirement is a consumer protection, and applies to private party vehicle sales as well as to dealers.

I can't find this as a law quickly but have always thought it was. I wouldn't sell a car with thoughts that it may not pass. I have sold cars that I knew were ok and the buyer paid for emissions.

Well it passed before but I added a CAI "oh man not a intake" but my parents dont think thst the car will pass becasue of the intake?

I really don't think an intake is going to be the cause of a car failing. If it fails the biggest things are 1) O2 Sensor(s) 2) Cat

Yeah and when I purched the car they changed the Cat and the o2 after it failed then it passed so hopeully it will pass agian

ok it also burns oil if I were to shift at about 5500 or 6500 is that bad or will that effect the emissions at all?

All dealerships are required to provide a current e-test. Privatly sold is a little different. You must put on the bill of sale that the car is sold without a current e-test and is as is.
