I suppose if the attempted theftery takes place on your personal property you still have the right to shoot them though

The right of no person to keep and bear arms in defense of his home, person and poperty, or in aid of the civil power when therto legally summoned, shall be called into question; but nothing herein contained shall be construed to justify the practice of carrying concealed weapons.

Yes, but we live in the land of "let's just forget about what the constitution says, or at least pretend it was meant to mean something else".

At least we aren't in San Francisco (http://www.foxnews.com/story/0,2933,175347,00.html) or New Orleans (http://www.reason.com/hod/dk091005.shtml), but the Colorado constitution does allow the governor to restrict firearms during a crisis, even though the federal Bill of Rights doesn't allow that.

Though this may be true, my guess would be that when I go to court, the jury will vote in my favor against some dumbass thief who had his bad karma catch up with him.

its when the person's family/estate sues for use of excessive force that you'll get reemed a new one

In Texas we have the right to use deadly force to protect our personal property. Even if it's something as small as taking my son's tricycle out of my front yard, I could kill them and there would be nothing the law could(or would) do about it.
