View Full Version : The state of HAI vs. Flaming Retard driver (my car got hit..again may need help)

So last night I was on my way home from work..and stopped at the intersection in front of the Prominade on Church Ranch...and WHAM! this idiot rear ends me in the del Sol. I get out..look at the damage, couldnt really see "much" and hes like..hey, its ok man...I'm like well, lets pull over here and check it out. I write down his license plate cause he seemed kinda shady about wanting to pull over somewhere and got into my car.

Well anyway..I'm looking at the damage in some better light..and the kid tells me..."this isnt my car man, and there isnt any insurance on it either" so I'm like...ok great..we are going to call the police. A few minutes go by and the Westminster PD shows up..talks to me gets my story, talks to the kid, gets the same story...but he tells the police officer that he doesnt have a drivers license either. I was getting flaming pissed by this time..the officer noticed it, and came over and talked to me..asked me to get in my car, and wait for another officer to come over since this jackass was going to be getting a "few" tickets.

Anyway, so another officer shows up, pulls me aside..I rehash story..and he goes and talks to this kid again, so I'm sneaky and roll the back window down on the del Sol so I can hear them...he then tells the officer that his license JUST got taken away because he got a DUI!!!!!

Fucking unbelievable...

So, I only have liability on my car...and they said I'll have to take this guy to court for the damamges unless their investigation turns up some insurance on the car...somewhere.

Anyway, this kid was driving a car that wasnt his, without a license, and without insurance...because he already got arrested for a DUI!!!

I think I'm going to have to sue him...anyone ever done such a thing before...not really sure where to start, havent really looked into it either, just thought I'd post about it first and see if anyone could help. The damage isnt a LOT..mostly just paint damage to the rear bumper (which was just repainted 4 or 5 months ago) and it seemed to maybe break a few of the clips that hold it on...but thats about it. Needless to say, I'm a little unhappy about the situation..and trying to consider my options here before I just drive over and set his house on fire.

Anyone help a brother out?

Please let me know..he IS going to pay, one way..or another... :ring:

Get a few estimates from body shops around town. Start off by talking to the kid and seeing if he or his parents will pay the damages. If not, you'll have to take them to small claims court, depending on the damage amount. I believe small claims is anything under $2000 but that may have changed.

If you go to court and get a judgement, he will probably only have to pay $15 a month for the rest of his life. Don't expect to get a check for the full amount any time soon. :(

I went through this a year and a half ago.... Here's the deal. The best you can do is take him to small claims or a civil suit.... Depending on how old and the judge will determine if you can go after the parents for the money. 90 percent of the time you cant. Unless there were massive medical bills.. I won my judgement for 2200 dollars. The other person gets a thing on their credit report saying that they owe money. But other then that their is no real reason for them to pay. So now you need to collect. Well you can pay the sheriffs dept to go to his house ( if he has one) and confiscate shit but this is stupid because you pay like a 50 dollar fee so they will even go. You can turn it into a collection agency which is a little easier but they will take 40 percent of whatever they get. They will do all the leg work though to garnish wages, or confiscating things that have liens on them. The court can order payments but like someone else said. You will get like 10 dollars a month nothing near anything that helps.

Dollar limit is $7500 for small claims court in CO. You'll most likely have to sue him in small claims court for it unless by some miracle he pays. After that you'll have to do all the leg work if you want to recover your money. Good luck Mike.

my moms car got rear ended in the same place the fucker was drunk and took off but the po's caught him after he ditched his car, the damage to her car was $6,000

I was hit by an uninsured motorist once. I was in a 1-ton pickup, he hit me in the front left corner, in a Audi wagon. Broke his engine block in two. We agreed in writing, and had it notorized that he would pay $250 a month until paid in full or I was suing him for the whole amount. I met him once a month at King Soopers where he gave me a money order.

Pretty sure hes not..prolly 18 to 22 or thereabouts...I'll find out as soon as I get a copy of the police report I guess. Amazing that you could do something like that..get a little slap on the hand and be on your way. As far as I can tell..he broke quite a few laws...I'd think he deserves a while in jail...maybe hes still there, who knows. He doesnt live too far away however, I made sure to have the police give me the information on who he was, and the car owner.

Shitty thing is..its not my car. :( Its been hit 4 times in 9 months now..I think thats a pretty strong record! I just need someone (that has insurance) to hit the drivers side...it needs some love now that the entire rest of the car has been repainted. ;NutKick;

Honestly the whole situation sucks, more then likely you won't get a dime out of him nor his parents (if he's a minor) especially if they're letting him drive around without a lic. or ins, they obviously could give a shit about him or what he does.

You may also be able to sue the owner of the car. They may have some liability in this seeing as they gave the keys of an uninsured car to an unlicensed driver.

Well if the owner of that car has insurance I think you can get something from the insurance.

I don't see why you couldn't file a claim and sue him, especially since the cop gave you the same advice.

Its a 1994..with a whole lot of miles..I really dont see the point otherwise. Could buy a new one after paying full coverage on it for 2 years.
